1. SCOPE OF APPLICATION

The Terms and Conditions set forth below shall apply to all use of www.justrockinout.com (the "Website") and purchase of products through the Website.  By using the Website or purchasing through the Website, you agree to these Terms and Conditions.  Please read them carefully.  By using the Website or purchasing products through the Website, you agree that all agreements, notices, disclosures and other communications that Just Rockin’ Out provides to you electronically satisfy any legal requirements that such agreements, notices, disclosures and other communications be in writing.

2. YOUR ORDER

Just Rockin’ Out only sells products through the Website to individuals who are able to purchase its products using a credit card or PayPal account.  If you are under 18 years old, you may use the Website only with the involvement of a parent or guardian.  By purchasing a product using the Website, you represent to Just Rockin’ Out that you are authorized to make the purchase using the credit card or PayPal account information you provide.  When you use this Website, you are responsible for maintaining the confidentiality of your access information and for restricting access to your computer.  You agree to accept responsibility for all activities that occur on your computer relating to any use of the Website or any purchase of Just Rockin’ Out's products through your computer.

• Due to differences in lighting, your computer settings, etc., colors can differ.

• All custom tie dye items are individual works of art and results can vary.  Contact Captain Tie Dye at info@justrockinout.com for questions regarding a custom tie dye item prior to placing your order.

• All custom engraved items are individual works of art and results can vary.  Contact us at info@justrockinout.com for questions regarding an engraved item prior to placing your order.  You will receive an email to confirm the customization prior to engraving.  You must respond to the email with your approval of the proof.

3. COMPLETION OF A PURCHASE

Just Rockin’ Out utilizes PayPal payment processing for all products ordered through the Website.  You do not need to have or create a PayPal account in order to purchase items from the Website.  You may choose to use or create a PayPal account or pay by credit card using the PayPal payment processing tool during checkout.  Any orders placed on this Website constitute a binding offer by you to conclude a purchase with Just Rockin’ Out.  The binding purchase agreement comes into existence only when Just Rockin’ Out accepts your order on the Website by sending you an email or written communication, or by shipping the products ordered.

 

4. TAXES

Where Just Rockin’ Out is required by law to collect applicable taxes relating to your order, you authorize Just Rockin’ Out to charge the applicable taxes to your credit card.

 

5. RESERVATIONS AND EXCEPTIONS

Just Rockin’ Out reserves the right to change prices, terms, specifications and warranties for products on this Website at any time without prior notice.  Just Rockin’ Out attempts to post accurate information, but errors may sometimes occur.  Any such errors in product specifications, descriptions and pricing will be corrected when discovered and Just Rockin’ Out reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions, including after an order has been submitted.  If an error in pricing is discovered after your order has been submitted, Just Rockin’ Out will inform you of the error at which time you may cancel or confirm your order at your option.

 

6. PRODUCT AVAILABILITY

Once Just Rockin’ Out accepts your order, it will promptly attempt to fill the order, subject to available inventories.  Should an item not be available, Just Rockin' Out will refund you the purchase price for the item, associated taxes and shipping.

 

7. TERMS OF PAYMENT

The final purchase price for the products ordered by you is due at check out from Just Rockin’ Out.  Just Rockin’ Out will charge the PayPal account or credit card you identified when your order was placed for the purchase price, the cost of shipping and handling and applicable taxes.  You may not make any offset against Just Rockin’ Out's claim for payment unless the amount set-off is not disputed by Just Rockin’ Out or has been the subject of a final and binding judgment against Just Rockin’ Out.

 

8. SHIPPING, DELIVERY AND RESERVATION OF TITLE

With the exception of orders including Made-To-Order Tie Dye, custom jewelry and custom engraved items, all orders are shipped within 48 hours after full payment has been received, Monday through Friday.  Made-To-Order Tie Dye and custom jewelry items require an additional 48 hours for processing.  Custom engraved items may require an additional 72 hours for processing.  Additional processing or shipping time due to unexpected service delays (severe weather, natural disasters, unscheduled events, pandemic, national emergencies, etc.) may be required.  

 

All items in a single order will be shipped together to reduce your shipping costs.

 

The products ordered from the Website will be delivered to the address entered by you through a delivery service selected by Just Rockin’ Out.  You agree that the products ordered and sent to you remain Just Rockin’ Out's property until full payment has been received by Just Rockin’ Out.

 

Delivery to U.S. addresses may take 2 to 10 business days after shipment is completed, depending upon your location.  Shipping costs are calculated for each shipment and displayed at checkout.  Free shipping is available to U.S. customers when orders exceed $65.00 before tax and shipping charges.

You may choose free local pickup at checkout.  Local delivery is available in Bullhead City, Arizona, and locations within a 30 mile radius of Bullhead City, Arizona.  Just Rockin' Out will contact you to discuss options for pickup/delivery.

International Shipping, Customs, Duties and Taxes

The Website does not ship to all international locations.  If you receive a message stating shipping costs cannot be calculated, please contact us at info@justrockinout.com so we can review your individual country's shipping policy.

When ordering from the Website, you are responsible for assuring the product can be lawfully imported to the destination country.

The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of the United States may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance are borne by the recipient.  Customs policies vary widely from country to country.  You should contact your local customs office for more information.

International customers and customers shipping products internationally need to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities.

Delivery may take two to four weeks or longer, depending on the destination country.  When customs clearance procedures are required, it can cause delays in delivery.

Shipping costs are calculated at the time of your order.

 

9. REFUND POLICY

If you are not 100% satisfied with your Just Rockin’ Out item, you may return it within 14 business days for a refund or exchange as described herein.

Reminders:

• Photos of jewelry items and other products may not show the actual size.

• Colors may vary due to the color calibration of each individual computer monitor.

• All custom tie dye, jewelry and engraved items are individual works of art and results can vary.

• Customized items will be refunded only if an error is made by Just Rockin’ Out or if item is damaged during shipment.  No refunds will be issued for errors made by the buyer during the customization process.  You are responsible for the accuracy of your customized requests.

Returned or exchanged products must be unused, unworn, in the condition you received them and in the original packaging.

 

How To Return An Item

• If your item contains a defect or is not consistent with the description of the product you ordered, please contact us via email at info@justrockinout.com to describe the issue and request a refund.

• After reviewing your issue, we will assign you a return number.

• Within 5 business days of receiving the return number, mail your item via USPS to the address provided with the return number.

• Include in your package a signed letter stating the reason for your return.  Please include the return number on the letter and a copy of the original receipt.

Return Exceptions

Item(s) must be returned in original, unused condition with the original packaging. If there are any signs of wear, smells of perfumes or smoke, the item will be mailed back to you and no refund issued.  Merchandise that has been worn, used, or altered will not be accepted for return or exchange.

Customized items will be refunded only if an error is made by Just Rockin’ Out or if item is damaged during shipment.  No refunds will be issued for errors made by the buyer during the customization process.  You are responsible for the accuracy of your customized requests.

Refund
When we receive your package, we will process the return within 5 business days. You will receive a refund for the purchase price less all shipping costs.

 

Restocking Fee
Unless there is a defect in the product, all items are subject to a 10% restocking fee.  This will be deducted from your refund.  We also do not refund the original shipping and handling that you paid on the order.

 

Exchanges

If your item is in new condition and has not been customized, you may exchange it for a similar item of the same price. You will not be subject to a restocking fee in this case, but you still will have to pay shipping costs.

 

10. WARRANTY AND LIMITATION OF LIABILITY

JUST ROCKIN’ OUT HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

THIS WARRANTY REPRESENTS JUST ROCKIN’ OUT'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY FOR DEFECTS IN MATERIALS AND WORKMANSHIP.  JUST ROCKIN’ OUT WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ITS PRODUCT(S), INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY HAVE OTHER RIGHTS, WHICH MAY VARY FROM STATE TO STATE.

The exclusion or the limitation of liability for damages according to the above paragraphs also applies to potential claims against employees or authorized representatives of Just Rockin’ Out.

 

11. APPLICABLE LAW

By using this Website, you agree that the laws of the state of California shall govern these Terms and Conditions without giving effect to any conflict of laws principles.  Just Rockin’ Out reserves the right to make changes to the Website and these Terms and Conditions at any time by updating this posting.  By using the Website, you agree to be bound by the Terms and Conditions in effect at the time of your use and/or purchase.

 

12. DISCLAIMERS AND LIMITATIONS OF LIABILITY RELATING TO USE OF THE WEBSITE

The Website is provided on an "AS IS" and "as available" basis.  Neither Just Rockin’ Out nor its affiliates, subsidiaries, or designees, nor each of their respective officers, directors, employees, agents, third party content providers, designers, contractors, distributors, merchants, sponsors, licensors, or the like (collectively "affiliates") warrant that use of the Website will be uninterrupted or error-free.  Neither Just Rockin’ Out nor its affiliates warrant the accuracy, integrity, or completeness of the content provided on the Website.  You expressly agree that use of the Website is at your sole risk.

You agree that under no circumstances shall Just Rockin’ Out or its affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Website, including but not limited to reliance by a user on any information obtained on the Website or that result from mistakes, omissions, interruptions, deletion of files email errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of nature, communications failure, theft, destruction or unauthorized access to Just Rockin’ Out records, programs, or services. The foregoing limitation of liability shall apply whether in an action of contract, negligence, or other tort.  Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such state’s liability is limited to the fullest extent permitted by law.

Right to Suspend or Cancel User Account
Just Rockin' Out may permanently or temporarily terminate or suspend your access to the Website without notice and liability for any reason, including - if in our sole determination - you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.

13. PROPRIETARY RIGHTS

Content included on or comprising the Website, including information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material (collectively "content") are protected by copyrights, trademarks, patents, and/or other proprietary rights.  All content is copyrighted as a collective work under the U.S. copyright laws and Just Rockin’ Out owns, to the fullest extent allowed by such laws, the copyright in the selection, coordination, arrangement and enhancement of such content.  Except as expressly authorized or licensed, you may not copy, modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale, lease or rental of, create derivative works from, or in any way exploit any of the content, in whole or in part.

14. COMPLETE AGREEMENT

You may not modify, delete or amend these Terms and Conditions in any manner without the express written agreement of Just Rockin’ Out.

Right to Change and Modify Terms
Just Rockin' Out reserves the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When the Terms are changed in a material manner, the Revision Date at the top of this page will be updated. Your continued use of the Website after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the Website.
